Privacy Policy

Modesign, operated by Shark Network Services Ltd runs the website builder at modesign.website. For the personal information described here we are the data controller. You can reach us about privacy at director@shark.mu.

This policy covers people who use Modesign to build websites. Visitors to a website built with Modesign should also read that business's own privacy notice: the business decides what its site says and collects, and we host it on their behalf.

• Account details: your email address and, if you add them, your name. If you sign in with Google we receive your name, email and profile picture from Google.
• Your websites: the business details, text, photos, videos and settings you enter, including any contact details you choose to publish.
• Billing: your plan, subscription status and the customer and subscription references Paddle gives us. Paddle collects your card and billing address directly; we never see or store your full card number.
• Enquiries: what you send us, for example through the “Custom websites” quote form or by email.
• Technical data: server logs with IP address, browser type and the pages requested, kept for security and troubleshooting.

• To create your account, sign you in and run the Service you asked for (performance of our contract with you).
• To publish your websites, connect your domains and store your files (contract).
• To handle subscriptions, trials and billing with Paddle (contract and legal obligations such as tax records).
• To send service emails, such as sign-in links, billing notices and important changes (contract). We do not send marketing emails without your consent.
• To keep the Service secure, prevent abuse and fix problems (our legitimate interests).
• To answer your enquiries, including custom website requests, which our Shark web design team replies to with a quote (your request and our legitimate interests).

We do not sell your personal information, and we do not use it for advertising.

We use a small number of trusted providers who process data for us under contract:

• Paddle (payments, invoicing and sales tax, acting as our reseller);
• Mailgun (sending sign-in and service emails);
• Vultr (servers that run the Service and store its database);
• Bunny.net (storing and delivering images and videos);
• Google, only if you choose to sign in with Google;
• Anthropic, only once the optional AI writing assistant is available and you choose to use it, to generate suggestions from the details you provide;

We may also disclose information if required by law, or to protect the rights and safety of our users or the public.

Our providers may process data in countries other than yours, including the United States and the European Union. Where the law requires it, we rely on safeguards such as the European Commission's standard contractual clauses.

Modesign uses one essential cookie to keep you signed in, plus a short-lived security cookie during sign-in. We do not use advertising or tracking cookies, so there is no cookie banner. Paddle sets its own cookies inside its secure checkout to process payments and prevent fraud.

• Account and website data: while your account is open. When you close your account we delete your sites and files within 30 days, and remove them from backups within a further 60 days.
• Billing records: as long as tax and accounting law requires, usually up to 7 years.
• Server logs: up to 90 days.
• Enquiries: up to 2 years, unless they lead to a project.

Depending on where you live, you may have the right to access, correct, download or delete your personal information, to object to or restrict how we use it, and to withdraw consent. You can update most details yourself in your dashboard. For anything else, email director@shark.mu and we will reply within 30 days.

You also have the right to complain to your local data protection authority. In Mauritius that is the Data Protection Office; in the EU or UK it is your national supervisory authority.

We use encryption in transit (HTTPS), access controls and regular backups to protect your information. No system is perfectly secure, and we will tell you and the relevant authorities about a breach where the law requires.

Modesign is not intended for children under 16 and we do not knowingly collect their information.
