Terms of Service

These terms are an agreement between you and Modesign, operated by Shark Network Services Ltd (“Modesign”, “we”, “us”) for using the website builder at modesign.website and the websites you publish with it (the “Service”).

By creating an account you agree to these terms. If you use Modesign for a business, you confirm you are allowed to accept them on its behalf.

• You need a valid email address. We sign you in with a one-time link sent to that address, or with Google.
• Keep access to your email secure: anyone who can read it can sign in to your account.
• You must be at least 16 years old, or the age of digital consent where you live if that is higher.
• Tell us straight away at director@shark.mu if you think someone else has accessed your account.

Free plan. One single-page website on a modesign.website address, 100 MB of storage and a small “Made with Modesign” badge. We may change free plan limits with reasonable notice.

Pro plan. €16.99 per month or €143.88 per year (prices in euros, before any sales tax), with the features shown on our pricing page. “Unlimited pages” is subject to fair use: up to 100 pages per website, far more than a typical business site needs. New Pro subscriptions start with a 3-day free trial. A card is needed to start the trial and you are charged when it ends unless you cancel first.

Our reseller. Payments are processed by Paddle.com, who act as our reseller and merchant of record. Paddle handles billing, invoices, sales tax and payment support, and their buyer terms also apply to your purchase.

Renewal. Subscriptions renew automatically at the end of each billing period until cancelled. If a payment fails, Paddle will retry it for a short period; if it still fails, your account moves to the Free plan.

Price changes. We will tell you at least 30 days before a price change affects your subscription. You can cancel before it takes effect.

You can cancel at any time from the Billing page in your dashboard. Pro stays active until the end of the period you have paid for, then your account moves to the Free plan.

On the Free plan your sites stay online, but Pro-only features stop working: extra pages are hidden, custom domains are disconnected, the badge returns and background videos stop playing. Your content is kept, so upgrading again brings everything back.

Refunds are covered by our Refund Policy.

You own the text, photos, videos, logos and other material you add to Modesign (“your content”). You give us a worldwide, non-exclusive licence to store, copy, display and serve your content only as needed to run the Service, for example to publish your website and make backups.

You are responsible for your content and confirm that you have the right to use it, that it is accurate, and that it follows the law where your business operates, including consumer, advertising and privacy rules for your own visitors.

The templates, design, code and example content provided by Modesign remain ours. You may use them as part of websites built with the Service.

You must not use Modesign to publish or do anything that:

• is illegal, fraudulent, deceptive or impersonates another person or business;
• infringes someone else's copyright, trademark or other rights;
• is phishing, malware, spam, or collects passwords or payment details under false pretences;
• is hateful, harassing, sexually explicit or exploits children;
• sells or promotes illegal goods or services, weapons, or regulated products without the required licences;
• tries to break, overload, probe or get around the security or limits of the Service.

We may remove content or suspend a site or account that breaks these rules. Where reasonable we will tell you first and give you a chance to fix it, but we may act immediately to prevent harm.

Our plans are designed for normal small-business websites. “Unlimited” and plan allowances are subject to this fair use policy so the Service stays fast and affordable for everyone.

• Pages: up to 100 pages per website on Pro.
• Storage: 100 MB on Free and 2 GB on Pro, shared by photos and videos. Photos can be up to 5 MB each and background videos up to 50 MB each.
• Traffic: there is no fixed traffic limit. Ordinary business traffic, including busy periods, is always fine.
• Not allowed: using a site mainly to host or share files, stream video or audio, run downloads, store backups, or serve content to other websites or apps.

If a site uses far more resources than a typical business website, or slows the Service for others, we will contact you first and help you fix it, for example by optimising large files. If the use continues, we may offer a custom plan or limit that site. We will not delete your content without notice.

Free addresses on modesign.website are provided for as long as your account is active. We may refuse or reclaim an address that is misleading, offensive or reserved.

On Pro you can connect a domain you own. Domain names are not included in any plan. You remain responsible for registering, renewing and paying for that domain with your own provider. We issue and renew the security (HTTPS) certificate automatically while the domain points to us.

We work hard to keep Modesign fast and available, but we do not guarantee it will always be uninterrupted or error-free. We may carry out maintenance, and we may add, change or remove features. If we remove a major paid feature we will give you reasonable notice.

Keep your own copies of important content. We make regular backups but cannot promise that content can always be recovered.

An optional AI writing assistant is coming soon. It is not included in the Free or Pro plan price: you can choose whether to use it, and any charge for it will be shown clearly before you agree to pay. When available, it will suggest wording from the details you give it. Suggestions can be wrong, so always review them before publishing. You are responsible for the content you choose to publish.

You can ask us to close your account at any time by emailing director@shark.mu. Cancel any active subscription first. When an account is closed we take its sites offline and delete its content as described in our Privacy Policy.

We may close an account that seriously or repeatedly breaks these terms, or that has been inactive on the Free plan for more than 12 months, after warning you by email.

Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer.

Otherwise, the Service is provided “as is”. We are not liable for indirect or consequential losses, such as lost profits, lost business or lost data. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim, or €50 if you have only used the Free plan.

We may update these terms. If a change materially affects you we will email you at least 30 days before it applies. Continuing to use Modesign after that means you accept the new terms.

These terms are governed by the laws of Mauritius, and the courts of Mauritius have jurisdiction, unless the law where you live as a consumer gives you the right to bring a claim locally.
